These terms of use are a legal agreement between you and Clothing Market ("Clothing Market", "we", "us", "our"), the operator of clothingmarket.co.uk (the "Site"). Clothing Market is a trading name of Canterbury Plasterers Ltd. By visiting the Site, creating an account, listing an item, buying, bidding, making an offer or messaging another member you agree to these terms. If you do not agree, please do not use the Site.
1. What Clothing Market is, and what it is not
- Clothing Market is an online marketplace for clothing, footwear and accessories in the United Kingdom: new and pre-loved fashion listed by private sellers, boutiques and brands.
- Clothing Market is not the seller of any item unless a listing says so. We do not hold stock, we do not inspect items, we do not hold money on anyone's behalf and we are not a payment provider, courier or escrow service.
- Every sale, auction, offer, exchange or return is a contract directly between the seller and the buyer. We are not a party to it and we do not guarantee that a seller will deliver or that a buyer will pay.
- Clothing Market shares one pool of listings with marketcity.co.uk. An item listed on either site appears on both, and your account works on both.
2. Who may use the Site
- You must be at least 18 years old to create an account, sell, bid or buy. Under 18s may browse only.
- You must give accurate details when you register and keep them up to date. One person, one personal account. Businesses may hold a business account in addition to a personal one.
- We may refuse, suspend or close an account at any time where we believe these terms have been broken, where we see fraud or abuse, or where the law requires it.
3. Your account and security
- Keep your password private. You are responsible for everything done through your account until you tell us it has been compromised.
- Sign in with Google or Facebook creates the same kind of account. We only receive your name, email address and profile picture from those services.
- We may send you service messages about your account, listings, orders, bids and messages. You can switch marketing off, but service messages are part of using the Site.
4. Listing an item
- Listing is free for private sellers. Any paid features are shown with their price before you buy them.
- You may only list items you own or are entitled to sell, and you must describe them honestly: brand, size, condition, material, flaws, alterations and whether the item is new, new with tags or used.
- Photographs must be of the actual item. Stock images may only be used for new items sold by a business seller, and the listing must say so.
- Prices must be the full price the buyer will pay for the item. Postage must be shown separately and must be reasonable.
- We may edit, move, hide or remove a listing that breaks these terms or the law, and we may limit how many items an account can list.
5. Items that may not be listed
- Counterfeit, replica or unauthorised branded goods. Selling fakes is a criminal offence in the UK. Listings of counterfeit items are removed and the account is closed and may be reported to Trading Standards and the brand owner.
- Stolen goods, goods obtained by fraud, and items you do not have the right to sell.
- Used underwear, swimwear bottoms, hosiery or other intimate items unless new and sealed. Used items of that kind may not be listed for hygiene reasons.
- Items made from protected species (for example ivory, certain furs and reptile skins) unless you hold the required certificates and say so.
- Weapons disguised as clothing or accessories, and any item whose sale is restricted or unlawful in the UK.
- Items that promote hatred, violence or discrimination, or that infringe someone else's trade mark, copyright or design right.
6. Buying, bidding and offers
- A bid in an auction is a binding offer to buy at that price. The highest bid at the end of the auction wins, subject to any reserve price. Do not bid unless you intend to pay.
- An offer accepted by the seller, and a purchase through the cart, are binding agreements between you and the seller.
- Payment methods are chosen by the seller (for example bank transfer, cash on collection or a payment link). We do not process or hold payments. Pay only through the method shown in the listing or agreed in messages on the Site, and never send money to anyone who contacts you outside the Site.
- Check the size, measurements and condition before you buy. Sizes vary by brand and country, so ask the seller for measurements if you are unsure.
7. Business sellers and consumer rights
- If you sell in the course of a business you must register a business account, display your business name and address, and comply with the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Digital Markets, Competition and Consumers Act 2024.
- This means, among other things, that consumers buying from you at a distance normally have 14 days to cancel and return the item, items must be as described and of satisfactory quality, and your returns policy must be shown in the listing.
- Private sellers are not covered by those distance selling rules, but items must still be as described and you must not mislead buyers.
- Sellers are responsible for their own tax. HMRC receives information from online marketplaces about sellers who exceed the reporting thresholds.
8. Delivery, collection and returns
- The seller and buyer agree between them how the item is delivered or collected. Use tracked postage for anything of value and keep proof of posting.
- Risk in the item passes to the buyer on delivery. If an item does not arrive or is not as described, contact the seller first through the Site's messages. If you cannot resolve it, you may report the seller to us and, where relevant, to your payment provider or the police.
- Returns are between buyer and seller. Business sellers must honour the consumer's statutory rights. Private sellers may accept returns at their discretion.
9. Messages and conduct
- Messages on the Site are for arranging sales. Do not use them to send spam, advertising, links to other sites, threats, abuse or requests for personal or payment details that are not needed for the sale.
- Do not ask another member to complete a sale outside the Site to avoid its protections, and do not share phone numbers or addresses in public listings.
- We may read messages where we investigate fraud, abuse, a report from a member or a legal request, and we use automated checks to spot scams.
10. Fees
- Listing is free for private sellers. Where a paid feature exists, its price is shown before you commit to it, is in pounds sterling, and includes VAT where applicable.
- Paid features are not refundable once the feature has started, except where the law says otherwise.
11. Content you post
- You keep ownership of the text and photographs you post. You give us a worldwide, royalty-free licence to show, copy, resize and promote them on the Site, on marketcity.co.uk, in search engines and on our social media accounts, for as long as the listing exists and for a reasonable time afterwards in caches and archives.
- You promise that your content does not infringe anyone's rights, is not defamatory and does not contain other people's personal data without their permission.
- We may remove content that breaks these terms and we may keep copies for legal reasons.
12. Reporting problems and takedowns
- If you believe a listing is counterfeit, infringes your rights or is otherwise unlawful, email [email protected] with the listing link and the reason. Rights holders may send a takedown notice to the same address.
- We act on reports promptly and we may remove a listing while we investigate.
13. Our liability
- The Site is provided as it is. We do our best to keep it available and accurate but we do not promise that it will be uninterrupted or error free.
- We are not liable for any loss arising from a sale, purchase, bid, offer, delivery or dispute between members, or from content posted by members, except where the loss is caused by our own negligence or fraud.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited under UK law.
- Where we are liable, our total liability to you in any 12 month period is limited to the fees you paid us in that period, or £100 if you paid none.
14. Intellectual property
- The Clothing Market name, logo, design and software belong to Canterbury Plasterers Ltd or its licensors. You may not copy, scrape, frame or reuse the Site or its listings without our written permission, other than for your own personal use of the Site.
15. Ending your account
- You can close your account at any time from your account page (Delete all my data). Open orders and disputes are completed first, and we keep the records the law requires us to keep.
- We may close accounts that break these terms. Serious breaches (counterfeits, fraud, abuse) result in a permanent ban.
16. Changes to these terms
- We may change these terms. The date at the top shows the current version. Material changes are announced on the Site or by email at least 14 days before they take effect. Continued use after that date means you accept the new terms.
17. Law and disputes
- These terms are governed by the law of England and Wales. Consumers living in Scotland or Northern Ireland also have the protection of the mandatory rules of their own country.
- Disputes go to the courts of England and Wales, or your local courts if you are a consumer. You may also use the UK's alternative dispute resolution schemes where they apply.
